By accessing or using our website, www.raregaming.net (the "Site"), you agree to comply with and be bound by the following terms and conditions (the "Terms"). By using this Site, you confirm that you are at least 18 years old or are visiting the Site under the supervision of a parent or guardian. You agree to comply with all applicable laws and regulations regarding your use of this Site and agree to be responsible for any content that you post.

• Eligibility: You must be at least 18 years old to use this Site. If you are under 18, you may use the Site only with involvement of a parent or guardian.

• Product Availability: We make every effort to ensure that all products displayed on the Site are available for purchase. However, some products may become out of stock or unavailable due to unforeseen circumstances.

• Pricing and Payment: All prices listed on the Site are in U.S. dollars. We reserve the right to modify product prices or change any product offerings without prior notice. By placing an order, you agree to pay for the total cost of the products, including applicable taxes and shipping fees.

4. Orders and Shipping

• Order Acceptance: Orders placed through the Site are subject to acceptance. We reserve the right to cancel or refuse any order at our discretion, including orders that appear fraudulent or violate our policies.

• Shipping: We currently ship within the United States and to select locations in Canada where shipping is offered at checkout. Available destinations, shipping methods, rates, and estimated delivery times may vary. Please refer to our Shipping & Returns Policy for additional information..

• Risk of Loss: Once your order has been shipped, the risk of loss and title for the items pass to you.

5. Returns and Refunds

• Due to the nature of sealed trading card game products, we generally do not accept returns of shipped products except where required by applicable law or where an order arrives damaged, incorrect, or materially not as described. Cancellations requested before shipment are subject to our cancellation policy. Please refer to our Shipping & Returns Policy for complete information.

6. Intellectual Property

• Rare Gaming Content: Except for third-party materials, content created and owned by Rare Gaming, including original website text, Rare Gaming names and logos, graphics, and other proprietary materials, is owned by Lala Labels LLC, doing business as Rare Gaming, and is protected by applicable intellectual property laws.

• Third-Party Materials: Product names, trademarks, artwork, images, software, and other materials owned by third parties remain the property of their respective owners and may be used on the Site pursuant to applicable licenses, permissions, platform terms, or law.

• Limited Use: You may not copy, reproduce, distribute, modify, or commercially use Rare Gaming-owned content without our express written permission, except as otherwise permitted by applicable law.

7. User-Generated Content

User-generated content submitted to Rare Gaming, including reviews, feedback, images, videos, comments, and other submitted materials, is governed by the User-Generated Content (Uploads) provisions in Section 8 below.

8. User-Generated Content (Uploads)
By uploading any content (including but not limited to photos, videos, reviews, or any other media) to the Site, you agree to the following terms and represent and warrant that:

• You are the sole owner of the content and have all necessary rights to upload and distribute it.

• The content is accurate, non-defamatory, and complies with all applicable laws, including intellectual property and privacy laws.

• You will not upload content that infringes on the copyrights, trademarks, or other rights of any third party.

• The content does not violate any applicable laws, regulations, or the rights of others (including privacy rights).

 

You acknowledge that any content you upload to the Site may be publicly displayed and available for others to view, comment on, or share.

By uploading images, videos, or other content to Rare Gaming, you agree to the following terms:

• Content Ownership:

  • You retain ownership of content you upload. By submitting content to Rare Gaming, you grant Rare Gaming a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, display, distribute, and promote the submitted content in connection with Rare Gaming's website, social media, marketing, promotional activities, and community features.

• Scope of Use:

  • Your uploaded content may be used to promote our products, showcase customer experiences, or feature in community highlights.

• Duration of Use:

  • The license granted above continues unless you request removal of your submitted content. Following a valid removal request, Rare Gaming will make reasonable efforts to discontinue future use of the content within 30 days. A removal request may not require withdrawal of materials that were already published, distributed, printed, or otherwise used before the request was received.

• User Responsibilities:

  • You confirm that you own the rights to the content you upload and that it does not violate any third-party rights (e.g., copyright, trademark, or privacy rights).

  • You agree not to upload content that is unlawful, offensive, or violates our community guidelines.

• Right to Remove Content:

  • Rare Gaming reserves the right to remove or decline to use any content that violates these terms, our community guidelines, or is deemed inappropriate at our sole discretion.

• Removal Requests:

  • If you wish to have your content removed, please contact us. We will process your request within 30 days.

• No Compensation:

  • By uploading content, you agree that you will not receive compensation for its use unless otherwise agreed in writing.

  • Participation in a published customer bonus program is governed by the eligibility described in our Shopping Guide.

9. License to Use Uploaded Content

The license granted to Rare Gaming for user-uploaded content is the license described in Section 8. No additional license is granted under this Section 9.

 

10. Prohibited Content
You may not upload content that:

• Contains illegal material, including hate speech, threats, or harassing content.

• Violates any person’s intellectual property rights, including copyrighted works, trademarks, and logos, without permission.

• Violates the privacy of others by sharing personal data or information without consent.

• Promotes or depicts illegal activities, violence, or harm to individuals or property.

11. Content Moderation and Removal
Rare Gaming (Lala Labels LLC) reserves the right to moderate, review, and remove any user-generated content that violates these Terms or is otherwise deemed inappropriate or offensive. We may also suspend or terminate user accounts for repeated violations of these Terms. However, we are under no obligation to monitor or review all content uploaded by users.

 

12. User Responsibility for Uploaded Content
You are solely responsible for the content you upload to the Site. Rare Gaming is not responsible for any errors, omissions, or inaccuracies in user-generated content. By submitting content, you agree to indemnify and hold harmless Rare Gaming (Lala Labels LLC) from any claims or disputes arising from your uploaded content.

14. Limitation of Liability

• Disclaimer of Warranties: The Site is provided "as is" and "as available," without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. While we make every effort to ensure the accuracy and quality of our products, we do not guarantee the condition or contents of any sealed product and are not responsible for any defects or damages that may occur once the product has been opened. All products are sold with no warranty, except as provided by applicable law. Any defects or issues should be addressed according to our Returns & Refunds Policy. This disclaimer does not affect any rights you may have under applicable Virginia law.

• This does not change any pack count, language, contents, or minimum sealed value expressly stated in a Rare Gaming product listing.

• Limitation of Liability: To the fullest extent permitted by law, Rare Gaming and Lala Labels LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or your inability to use the Site, even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to indemnify, defend, and hold harmless Rare Gaming, Lala Labels LLC, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses arising out of or in connection with your use of the Site or violation of these Terms.

16. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, if we believe that you have violated these Terms or engaged in fraudulent or harmful behavior.

 

17. Governing Law and Jurisdiction

These Terms, your use of the Site, and transactions with Rare Gaming will be governed by and construed in accordance with the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent permitted by law, disputes arising out of or relating to these Terms, the Site, or transactions with Rare Gaming will be subject to the jurisdiction and venue of the state and federal courts located in Virginia having proper jurisdiction.

 

Matters concerning the formation, organization, governance, internal affairs, or limited liability company agreement of Lala Labels LLC are governed by applicable Delaware law and may be subject to the jurisdiction of the courts of Delaware.

Nothing in these Terms limits any rights or remedies that cannot lawfully be waived under applicable federal or state law.

19. Easter Egg Hunt Event Disclaimer

The Easter Egg Hunt is a limited-time promotional event offered periodically by Rare Gaming and available only while supplies last. Finding or accessing a virtual egg may unlock access to a related product, offer, or other event content but does not reserve inventory or guarantee the ability to complete a purchase.

 

Specific event dates, products, purchase limits, eligibility requirements, promotional exclusions, and other rules may vary from one Easter Egg Hunt to another and will be disclosed on the applicable event page or related event materials.

 

Event products and offers are available on a first-come, first-served basis and may be modified, suspended, extended, or ended at Rare Gaming's discretion. Event features, layout, availability, and functionality may vary across devices, browsers, screen sizes, and assistive technologies.

 

If event-specific rules published for a particular Easter Egg Hunt conflict with this section, the event-specific rules will control for that event.

 

20. Treasure Hunt Event Disclaimer

The Treasure Hunt is a limited-time promotional event offered periodically by Rare Gaming and available only while supplies last. Participation does not guarantee that a customer will find a treasure, access a treasure-linked product or offer, or that any treasure will remain available for purchase when found or accessed.

Finding, viewing, accessing, or adding a treasure-linked product or offer to a cart does not reserve inventory or guarantee the ability to complete a purchase. A treasure is considered claimed only after checkout is successfully completed and the order is accepted.

 

Specific event dates, treasure quantities, purchase limits, eligibility requirements, promotional exclusions, rewards, values, clues, products, and other rules may vary from one Treasure Hunt to another and will be disclosed on the applicable event page or related event materials.

 

Rare Gaming may modify, suspend, extend, or end a Treasure Hunt at its discretion. Rare Gaming may also cancel, refund, limit, or reject orders or participation that violate the applicable event rules, involve misuse of the event, exceed stated purchase limits, or otherwise interfere with the intended operation of the promotion.

 

Treasure availability, access points, clues, timing, layout, and functionality may vary across customers, devices, browsers, screen sizes, and assistive technologies. Rare Gaming is not responsible for missed opportunities caused by unavailable inventory, cart expiration, payment delays, customer device or internet issues, browser limitations, third-party platform issues, or similar technical conditions outside Rare Gaming's reasonable control.

 

If event-specific rules published for a particular Treasure Hunt conflict with this section, the event-specific rules will control for that event.

21. Trick or Treat Event Disclaimer

Rare Gaming's Trick or Treat Bags are limited-time promotional mystery products offered periodically and only while supplies last. Specific event dates, product quantities, pricing, contents, themes, values, purchase limits, eligibility requirements, promotional exclusions, bonuses, and other event details may vary and will be disclosed on the applicable Trick or Treat event page, product page, or related event materials.

 

Trick or Treat Bags contain products selected and packaged by Rare Gaming as described on the applicable event or product page. Because these are mystery products, customers should not expect to receive any particular theme, classification, booster pack, card, set, product, or combination of products unless expressly stated otherwise. Customers purchasing multiple bags may receive duplicate themes, products, or contents.

 

Availability is first-come, first-served. Adding a Trick or Treat Bag to a cart does not reserve inventory or guarantee completion of a purchase. An order is subject to acceptance under these Terms and is not guaranteed until checkout has been successfully completed and the order has been accepted.

 

Trick or Treat products may be subject to event-specific promotional, discount, reward, return, or bonus restrictions disclosed on the applicable event or product page. Unless otherwise stated, Rare Gaming's general Shipping & Returns Policy and other applicable provisions of these Terms also apply.

 

Rare Gaming may modify, suspend, extend, or end a Trick or Treat event at its discretion, subject to applicable law. If event-specific rules published for a particular Trick or Treat event conflict with this section, the event-specific rules will control for that event.
